These Terms of Use govern access to and use of the Vitaliya website, platform, digital tools, pilot programmes and related services.
Vitaliya™ is a product of Rydex Technologies Ltd. By accessing or using Vitaliya, you agree to comply with these Terms of Use. If you do not agree with these terms, you should not use the platform or services.
Vitaliya is a workplace health intelligence platform designed to support organisations and individuals through data-informed workplace health, wellbeing, research and improvement initiatives. The features and functionality available to users may vary depending on the relevant programme, pilot, subscription or organisational agreement
Vitaliya provides workplace health information, insights and tools for informational, research, evaluation and improvement purposes.
The platform is not an emergency service and does not replace professional medical diagnosis, treatment or advice. Users should seek advice from an appropriately qualified healthcare professional regarding individual medical concerns or decisions
Where access requires an account, users are responsible for providing accurate and current information, maintaining the confidentiality of login credentials, not sharing credentials with unauthorised individuals, and notifying us promptly of suspected unauthorised access. Users are responsible for activities carried out through their account unless the activity resulted from a security failure attributable to Vitaliya or Rydex Technologies Ltd.
Users must not use Vitaliya for unlawful, fraudulent or harmful purposes; attempt unauthorised access to the platform, systems or data; interfere with the operation, security or integrity of the service; upload malicious software, harmful code or unlawful content; copy, reproduce or commercially exploit platform content without permission; attempt to identify individuals from anonymised or aggregated information; or use data obtained through Vitaliya for discriminatory, unlawful or unauthorised purposes.
We reserve the right to restrict or suspend access where these Terms of Use are materially breached or where necessary to protect users, data or the platform.
Unless otherwise stated, the Vitaliya name, brand, platform design, software, content, methodologies, graphics and related intellectual property are owned by or licensed to Rydex Technologies Ltd. Use of the platform does not transfer ownership of any intellectual property rights to the user
Participation in research studies and pilot programmes may be governed by additional information sheets, consent
processes, research protocols or participation agreements.
Where additional terms apply, users will be informed before participation. Participation in a research study may be
withdrawn in accordance with the information provided for that particular study.
Vitaliya may integrate with or provide access to third-party services. Rydex Technologies Ltd is not responsible for the content, availability or privacy practices of independent third-party services. Users should review the relevant terms and privacy notices before using those services.
We aim to provide a reliable service but cannot guarantee uninterrupted or error-free access at all times.
We may update, modify, suspend or discontinue features where reasonably necessary for security, maintenance, improvement, legal compliance or business reasons.
To the extent permitted by applicable law, Rydex Technologies Ltd will not be liable for indirect or consequential losses arising solely from reliance on general information or automated insights provided through Vitaliya.
Nothing in these Terms of Use excludes or limits liability where doing so would be unlawful.
Use of personal information in connection with Vitaliya is governed by the Vitaliya Privacy Policy and any additional privacy information provided for a specific programme, service or research activity.
We may update these Terms of Use periodically. Updated terms will be published on the website together with the date of the latest revision.
Continued use of Vitaliya after updated terms take effect constitutes acceptance of the revised terms, where permitted by applicable law.
